that said, for those following along at home, it does look like texas area Q (houston) still has 1,415 staffed beds open.

but it’s clear that mandating vaccination for medical workers is putting stress on medical worker counts. this is a terrible policy for about 100 reasons the top few that jump to mind being:

• it violates their rights
• it substitutes one size fits some policy made by bureaucrats for the individual judgement of medical professionals and vaccines represent a poor risk reward for most young, healthy people. you’re firing people for making sound medical judgements.
• these vaccines do not stop spread or provide sterilizing immunity. vaccinated viral load is as high as unvaccinated during the key contagion period. this is a personal, not a community choice.
• it makes no allowance for those who have had covid and recovered despite recovered immunity being stronger and vastly more sterilizing than vaccinated and the fact that vaccinating the recovered is a terrible risk reward for them
• it guts staffs and demoralizes workers at a time when they are needed.
• and safe, affordable treatment and exposure prophylaxis is readily available.

41% of the cleveland clinic staff who had not been infected with covid declined vaccination. this was likely not due to a paucity of good medical advice. rather, it was probably because they GOT good medical advice.

there is a funny thing about vaccine hesitancy:  the most educated are the most unwilling to get vaccinated.  (it’s also not “hesitancy.” that’s a weasel phrasing to try to make those engaging in rational cost/benefit analysis look like fraidy cats.)

when you make a mess, you should own it. then you should fix it.

no health worker should have governmental or bureaucratic diktat forced on them in place of their own medical judgement.

this is not a “fringe issue of the stupid, uneducated, and retrograde deplorables.” that’s pure gaslighting.

no hospital should be short staffed over such stupidity.

Our voices have been heard! There will be an appeal. Asa has retained his own counsel, as he will take the plaintiff’s side in favor of forced masking. The legislature properly passed a law to ban forced masking, and it must be upheld by the Arkansas Supreme Court.

Arkansas Attorney General Leslie Rutledge released a statement following her decision to appeal Judge Tim Fox’s decision blocking Act 1002, the state law barring public entities from mandating face masks.

“I will appeal the decision of Judge Fox which blocked Act 1002 from going into effect,” said Attorney General Leslie Rutledge. “For nearly seven years, I have always exercised my constitutional duty to represent the State of Arkansas and will continue to wholeheartedly defend state laws to protect Arkansans of all ages.”

Last Friday, Pulaski County Circuit Court Judge Tim Fox temporarily blocked Act 1002. That Act passed by the General Assembly and signed by Governor Hutchinson bars local governments from mandating face masks.

We have conferred with the Attorney General and her staff as we evaluated how best to proceed. We appreciate their representation of us to this point. However, given the number of parties and the potential for multiple conflicts, we believe our interests in this case are best served through retaining separate counsel. While we understand there are many different opinions as to the specific legislation at issue, the important role of the legislative branch must be preserved among our three, separate but equal, branches of government.”

Generally speaking, I support the decision of Judge Fox, and my position creates an unavoidable conflict; for that reason I have asked David R. Matthews of Matthews, Campbell, Rhoads, McClure & Thompson, P.A. to represent me.

No appeal yet from AG Leslie Rutledge:

After the Tim Fox kangaroo court hearing exactly one week ago, we must ask, “Where’s Leslie?”.  Has she held a press conference, promised to fight Tom Mars and the public school lobby for the people of Arkansas?  Has she filed an appeal to the Arkansas Supreme Court, which would almost certainly result in a reinstatement of Act 1002? 

Why is it important for you to push the AG’s office?

Tom Mars has promised that he is going after Act 977 next (bans vaccine mandates for public employees, teachers, and students).  He will surely go after Act 1030 too, in an effort to prevent you from buying groceries.  Asa has expressed his approval of Fox’s decision; he doesn’t want Rutledge to appeal.  Leslie needs to feel immense public pressure to appeal the corrupt Tim Fox ruling to the AR Supreme Court.  Call the Attorney General’s office (501-682-2007). The legislature is hiding behind the “we don’t have the votes” excuse.:

Ten brave senators voted to continue the special session, so that they could address the medical freedom issues.  The remaining Republicans are hiding behind the excuse that they don’t think they have the votes.  It is crucial that we support their efforts to reconvene and remind them that their constituents demand medical freedom legislation.  It will take a 2/3 vote in both the House and the Senate, so the bar is high, but we have enough Republican legislators to make it happen.  They need to hear from you repeatedly until they agree to re-convene and pass this important legislation intended to protect Arkansas workers from being forced to take a jab that they don’t want or need.
